THE LAST TWO YEARS. NOW MORE OF THE SAME?

Dear Fellow Unit Owners,

What has happened in our Village over the last two years?  Like anything else there’s good news and bad news.

Good news:  a 3% maintenance reduction.

Bad news:  
- For the first time ever ugly trailers are permanently parked in our community.  
- A record number of illegal dogs are disturbing residents and causing damage to common areas, now in recently renovated buildings.  
- Less activities than ever before, especially now that our seasonal residents are here.
- Sloppy workmanship on repairs and maintenance.
- Trash on the grounds is at an all time high.
- Garbage strewn inside the buildings is at an all time high.
- Vandalism is at an all-time high.

These problems are having a noticeably negative effect on our quality of life.  It also means that the property no longer shows as well, and that limits the potential growth of our property values.

The Board of Directors’ responsibilities boil down to just two things: 
Increase Property Values for unit owners, and
Enhance Quality of Life for all residents. 

One individual, John Labriola, is in total control of our community: 
He handpicked all the Board members.
He is the appointed President of the Association.
He decides which Rules and which of our Docs to enforce, 
and which ones not to enforce, like illegal dogs and trailers.
He chose and controls our unresponsive property manager.
He signs the checks.

The simple truth is Mr. Labriola (with the tacit approval of his Board) has allowed these problems to worsen over the last two years.  

Mr. Labriola, more than any other individual, is responsible for the deterioration of our Village.  If you are concerned about any of these problems, or you have other concerns about our community, it is your responsibility to let Mr. Labriola and his other Board members know

FISCAL MISMANAGEMENT

Dear Fellow Unit Owners,

Some unit owners have asked about how the Concerned International Village Owners Committee (CIVOC) functions.  

We are not an official committee in that we were not appointed by the Association president, we do not hold meetings, we do not vote on issues, and we do not report to the Board of Directors.  

CIVOC is a group of unit owners who share a deep concern for our community, mostly focusing on the financial challenges facing our Association.  We pay attention to what is going on and we report problems, especially when it comes to how the Association uses our funds.

Below are letters from two unit owners whose concerns about how our maintenance funds are being misspent are shared by many other unit owners.   Please review them and if you agree let the Board members know how you feel.

Subject:  Misuse of maintenance fees

Dear Board Members: 

I am writing to you, on our Nation's Independence Day celebration, because of the wrongful expenditures with our maintenance fees in defending our president, Mr. Labriola, in his personal legal defamation case. 

I can not believe in our condo documents there are any rules for paying legal fees for an owner.  Mr. Labriola, an owner, is being sued and therefore is responsible to pay his own way; as anyone who is being sued is responsible to do.

Why are we paying for his litigation? 

I am not responsible for his personal legal expenses, nor are any of the other owners who pay their maintenance fees for the upkeep of our community.  I am outraged that our monies are being misused and demand that not only do they stop, but that Mr. Labriola needs to reimburse the Association for those expenditures.

Is this something that can be reported to the State of Florida; the mishandling of Association fees for personal use?

I would appreciate a response.

Subject:  International Village Fiasco

To All Interested Parties,

It has come to my attention that Mr. Mirrow, a former board member, has suggested the he will provide
the Village with $3,000.00 to start work on the Zurich building where he lives.  This is not the way it works, just like all past projects, pulling a random number is the way of deciding which building is next. It is only fair and
it would not be prudent to allow a single individual to control this process. Instead of praising Mr. Mirrow we
should see this as what it is....buying his way into what should be a fair and impartial decision.

At the same time I would like to let you know that Harriet and I offered to give the Village $50,000.00 to build a playground next to the tennis courts for the growing number of kids residing in the Village, but this money was rejected.  Instead they formed a "fine committee" that will end up costing our Village large legal fees, not to mention the uselessness of such action.

As many of you know the foolishness in the Village continues, David Friedman has left and who can blame
him.  Harriet has paid $56.00 to Broward Tax office to correct the purchase price of her Bordeaux unit, one can only imagine how much in time and legal fees were wasted on this by this Board. And now we have the facts of Mr. Labriola’s personal legal fees being paid by this Board and our treasurer who seems uninterested in appearing in person at any Board meeting. 

Where are the audited financials results?

When will the people rise up.....for the sake of our Village I hope you care and will contact your Board.

SELECTIVE ENFORCEMENT

Dear Fellow IV Unit Owners,

Our Board of Directors has decided to prosecute two unit owners, Miriam Gordon and Geoffrey Edwards, alleged to be in violation of our R&R.  Both unit owners received a Notice of Violation which in and of itself has been an extremely rare occurrence in the Village.  The Fine Committee meetings are scheduled for this coming week.

It has been reported numerous times that John Labriola, unit owner, two term director and current Association President, has been in continuous violation of our R&R for years.  He has not attempted to cover up nor deny the violation.

For the Board to prosecute violations by two other unit owners but not Mr. Labriola - - - well, we all would agree that there’s a double standard going on here.  Do you think it’s a coincidence that both Ms. Gordon and Mr. Edwards have publicly disagreed with Mr. Labriola and voiced concerns with actions (or inactions) of the Association?  

The selective enforcement of our R&Rs by this Board is expanding.  Two unsightly trailers have been parked on our property next to the tennis courts, in direct violation of Section IX 1.b. of our Rules and Regulations.  In fact one of them has been there for months.  Management knows about these eyesores and has done nothing about it.  (In all fairness it must be noted that our property manager, David Friedman, has said repeatedly that he takes his direction from President Labriola.)

One can only conclude that the majority of Board members approve allowing these obvious violations.  But it is reasonable to ask if all the directors are actually aware of these actions because the decisions are being made:   (pick one)
- in secret
- behind closed doors
- without required notice to the unit owners. 

Please remember that the Board is also has been using our maintenance funds to pay lawyers in order to prosecute (persecute?) unit owner and fellow director, Wendy Hernandez, who has had the courage to voice a different point of view from Mr. Labriola.

The unit owners, especially those who were elected to the Board of Directors, should be aware that selective enforcement of our Docs and R&R was the root cause of the very costly 2011 lawsuits involving our Association.  The unit owners now on the Board need to consider the costs to the Association when deciding to prosecute only those unit owners who disagree with Mr. Labriola.  Please note that the Association is now paying additional legal fees because of the selective prosecution of Mr. Edwards.
  
Finally, earlier this year the unit owners voted to reaffirm Section 6.1.1 of our Bylaws which requires that all Association officers live in the Village.  But Marcio Jaspan, who does not live in our community and hasn’t attended a Board meeting in months, is still our treasurer.  How do our elected Board members justify this blatant disregard for our Bylaws and the will of the unit owners?

Fellow unit owners, is this what you voted for in the last election?

Good-bye Good Friend

Dear Fellow Unit Owners,

The Village lost a true friend last week.  Frances Mesirow passed away peacefully in her apartment at age 85.

Originally from Pittsburgh PA, Frances moved to Washington DC with her first husband, Edward Branchik, in 1949.  They had two children, Kathy and Richard.  After Edward’s death at age 40 in 1966, Frances married attorney Allen Mesirow, with whom she had worked for many years, in 1968.  Their marriage was described as “a match made in heaven.”

I spoke with her daughter Kathy for a short while and noticed that her speaking voice was quite similar to Frances’.  I mentioned that and Kathy recounted a memory from her high school years.

During this time Frances worked at her husband’s law office.  On one particular day Kathy was at her parents’ office when a call came in.  Frances was away from the phone so Kathy picked up.  The call was from one of Frances’ friends who, thinking Frances had answered immediately launched into a highly detailed description of her recent hysterectomy.

Kathy tried repeatedly to break into the woman’s narrative, but with no success.  Finally, Frances’ friend paused to take a breath and Kathy was at last able to say, “I…I…I think YOU think I’m my mother.” Kathy says she’s never been more relieved to end a telephone conversation than she was to end that one. 

Allen also died at a relatively young age, 62, in 1976.  Frances stayed in the DC area for awhile until she moved to St. Thomas in late 1979.  Frances left the Caribbean and became a resident of the Village in the mid-90’s.  She bought her unit in the Yorkshire in 2002.

Much of her life here was devoted to our Association.  She was elected to the Board in the mid 2000’s and again in 2012.  She focused her efforts on the sales and leases committee and the unit owners benefitted by her determination to keep the process honest, accurate and transparent.  She will be missed.

She leaves behind her two children as well as her two sisters, Dorothy Herrick and Margie McKenzie.

Notice the dramatic differences compared with the reports by Mr. Labriola in his recent email and blogpost. 

Please bear in mind that Mr. Labriola is an accomplished writer.  While these two unit owners may not have his writing skills, they certainly have a point of view worth understanding.

You should note that Mr. Labriola states that his writings represent the official position of our Association.  

Mr. Labriola has a First Amendment right to state his opinions.  But all members of the Board of Directors are individually and collectively responsible for the publication of those writings under the name of the Association, and are responsible for the consequences.

Subject: LEGAL FEES ASSESSMENT

Dear Unit Owners,

It brings me great sadness to have to construct this email. There is so much going on behind the scenes at International Village that it would take a lifetime to fill you in. But I feel that it is my FIDUCIARY RESPONSIBILITY to update you with the utmost honesty and truthfulness.

First of all, there was a time, when I was misled also by the current board president. I’ll admit, he had me fooled in the beginning and I believed that he was for us and our community.  It was soon after, when he became an officer that I began to see that everything was a political campaign and he showed his true colors.  Over the last year, more than I could ever share has transpired. I have seen so much corruption, abuse of power/access and misuse of monies but nothing has been done in favor of the association.  The problems with John and I began once I figured out his plan and when I began to oppose and contradict him. Once I stated that we should do the right things for the community, as we promised in our campaign, is when I became his #1 enemy.  I am embarrassed to even admit that I started out as part of the problem. Well, please afford me the opportunity to redeem myself.

During the last board meeting in March, I asked the property manager, David Friedman, about the problems that I noticed in my building.  I shared with the attendees that the building structure was crumbling and the manager stated that that was a board decision and not his. Needless to say, the current and present board members ignored my request.  As a result, I felt compelled to take matters into my own hands and report my concerns to city hall.  I am utterly embarrassed that I had to take this course of action because the voted members of the board did not think that my concerns were valid or of importance. So, I did what I felt I had to do as a paying owner of this community. I’m appalled to know, that each month, most of us are paying our maintenance and some are still paying past assessment fees but it does not seem like anything is being done to maintain the infrastructure of our community. Please see attached pictures.

It is also shocking and borderline criminal that he is using the scare tactics of a possible assessment because of my actions. He wants to blame me now if there is a future assessment but believe me when I say, THAT WILL HAVE NOTHING TO DO WITH ME. Our monies are being so misappropriated, misused and abused at this time that it is egregious and I’d dare to say felonious what this current board is doing. I am the scape goat because accusing me and filing a lawsuit against me distracts you from the real issues that this board’s president does not want you to become privy to.  I have no axe to grind. I am not out for vengeance. This is not a vindictive ploy to get back at him for not allowing me to have my way. That could not be further from the truth. But it sounds good doesn’t it? This board’s president believes that you’re all fools and not smart enough or courageous enough to see straight through him and challenge him on his actions. He wants you to sit back and give him carte blanche over our community and our monies. 

As far as the lawsuit that he has filed against me, this lawsuit is frivolous to say the least. Now let’s talk about vindictive, this is the epitome of vindictive. His purpose for this lawsuit is to exact revenge against me for being “disobedient” to him. I must make it clear that as the Board’s Secretary I was entitled to have access to ALL records, but that right was never granted.  It is a lie that I wanted to have total access to residents’ files for my own personal use. It was only and always for the purposes of association’s business. It is also a LIE that I provided confidential information to Mr. Weiss. 

John is suing me, and he is using our money to pay for his prosecuting attorney. There are a number of lawsuits pending and being filed against the association because of his arrogance and all of his legal fees will be funded WITH YOUR MONEY.  So, he could not care less how many lawsuits are filed because he is hiding behind the legal coverage provided to him as a board member and president. Many of the lawsuits filed, if not all, are a result of John not following condo docs, changing them as he pleases.  He denies the owners to have access to what is rightfully theirs as owners.

Be not confused owners, there have been 2 lawsuits against John personally and the rest are against the association because of his reluctance to provide information to owners, and there is more to come. Nonetheless, in ALL of these cases, John’s defense is being funded with the association’s money.  AMG and Mr. Weiss are suing him personally and the insurance company refused coverage for his defense when they realized that these suits were personal and had nothing to do with his fiduciary duties as a board member. John had the opportunity to ascertain evidence about AMG’s wrongdoings and Jason’s “criminal activities” by getting an official audit of our finances, as I suggested.  But John refused to do things the right way and chose instead to blast Mr. Levy on his personal blog. John was fully aware of what was going on. In addition, Marcio Jaspan and Duv Wolff, supported John knowing that his actions were irresponsible. John said that “International Village is now forced to pay for his defense.”  WE ARE PAYING FOR ALL HIS LEGAL FEES on personal cases not cases against him as a board member. Now it is MY FIDUCIARY RESPONSIBILITY TO MAKE YOU AWARE OF WHAT THIS CURRENT PRESIDENT IS DOING!

In Mr. Labriola’s blast email, he posed the question,” How do YOU, the unit owners, think that we should proceed”?

Owners, I now pose this question. HOW DO YOU THINK THAT WE SHOULD PROCEED IN DEALING WITH THE ACTIONS OF THIS CURRENT PRESIDENT?
Please make it a priority to attend tonight’s board’s meeting in the clubhouse at 7:15. The agenda is filled with items that I’m sure that you would be interested to hear about.

This is about the Board of Directors open board meeting that took place on 4/28/2015. Every owner has the right to complain to the City of Lauderhill Code enforcement that the way repairs and the upkeep are being neglected and are in need of repair, on the reports from code violation there are structural damage in spite of what John Labriola said in his Village View point letter, once again John Labriola is misinforming you owners however I and others owners have the report in writing from code violation.

If you go against John Labriola and do not agree with what John does or tells you this is where the harassment, personal attacks, retaliate, insulting comments, scare tactics and threats. If you are a paying owner who is current with the fees if you do not agree with John Labriola he will not let you talk in the board meeting then you are forced to talk out of turn then his threats to have you removed out of the meeting. I can understand somewhat that the employee's that are scared of losing their job if they do not obey John Labriola and do what he tells them to do. What I do not understand is the other Board Members that allow this type of unprofessional behavior to take place every meeting and they just sit there, what are they scared of it can't be they get paid and scared of losing their jobs. I know what is wrong you cannot act like grown men there is something very wrong when men are scared of other men and scared to speak up and let John Labriola harass women.

John Labriola if you keep on taking away my right to my freedom of speech and any form of harassment as a owner in the board meetings and continue to practice this type of behavior without any reason or cause. I am putting John Labriola on notice to cease this behavior at once if you make the choice not to stop this and it does continue then you can add to your long list of legal lawsuits against John Labriola and International Village for allowing sexual harassment to take place in a work place.

For the harassment, personal attacks, retaliate, insulting comments, scare tactics, threats and damaging her character I advise Wendy Hernandez to submit a cease letter to John Labriola and the board of directors if these attacks continue then a legal lawsuit should be filed.

YOU SHOULD KNOW


Fellow IV Unit Owners

There are things going on in the Village that many unit owners have little or no knowledge of.

The fact is that our funds have been spent by the Association because of decisions made behind closed doors.  

Decisions are being made behind closed doors that will cost us even more money in the future.

Lawyers and other professionals have been hired in secret.  

Decisions like these MUST be voted on at a Noticed meeting.  We, the unit owners, the ones who pay the bills, have an absolute right to know how our money is being spent.

Association President John Labriola, with the tacit approval by the Board of Directors, has retained counsel to defend himself and the Association from multiple lawsuits.  There has been no notice to the Membership about the fact of these legal actions.  And tens of thousands of dollars have already been spent without full disclosure to the unit owners.

The Board of Directors, led by John Labriola, is now considering whether to publicly shame Wendy Hernandez, a fellow Board member, and will also be considering whether or not to bring a lawsuit against her.  Why, because Wendy has the courage to disagree with Mr. Labriola.  Decisions will be made at a CLOSED meeting Tuesday night.  

Another unit owner has said that s/he is preparing a slander and harassment lawsuit against the Association due to the decisions of president John Labriola and the tacit approval of the rest of the Board.

There is a growing list of unit owners who have or will be suing Mr. Labriola and/or the Association due solely to Mr. Labriola’s intolerant, vengeful behavior.

From the moment he was elected to the Board back in 2013 he has consistently harassed and personally attacked any unit owner, especially Board members, who publicly disagreed with him.  From day one he brought his considerable writing and political skills to bear against anyone who dared to voice a different point of view. 

While he was in a minority on the Board he spewed his hateful ‘free’ speech without any measurable effect on the Association.  Now that he is the president of the Association, with the implicit and explicit support of the Board of Directors, our money is being spent in furtherance of his desire to hurt the people who disagree with him. 

Recently two unit owners (Miriam Gordon/St. Moritz and Wendy Hernandez/Zurich) observed unsightly and possibly unsafe conditions in their respective buildings.  They notified the Association and asked what could be done about the situation.  Property manager David Friedman, who has often said that he takes his direction from president John Labriola, did not properly respond.  

The two unit owners then spoke with the City of Lauderhill’s building department to get answers to their concerns.  (more on this later)  Because of this the Board, at Mr. Labriola’s direction, is taking retaliatory action against them.  These personal, malicious attacks are again opening the Association to yet more lawsuits.

It’s bad enough that a growing number of unit owners have to suffer vindictive attacks from Mr. Labriola just because some of us disagree with him.  Now it’s costing all of us money.

People, and that includes unit owners and directors, have the right to express an opinion without fear of reprisals from those in power.   Even though Mr. Labriola now gets to treat the Association as his own $3.5million kingdom the Village is still located within the United States of America. 

The unit owners have an absolute right to know exactly how our money is being squandered facilitating Mr. Labriola’s pernicious agenda.

FALLOUT

One aspect of the fallout from the news of the Jason Levy conviction is the unfortunate tone taken by John Labriola, and the other Board members.

Any possible unethical or criminal activity by Jason Levy is of primary concern to the Membership and also to AMG.  Jason was their employee.  In fact, they have more to lose than just money if Jason did anything wrong while he worked here.

The critical question is whether or not Jason got any Association money he shouldn’t have.  There are at least two audits of our accounts during the time that Jason was our manager.  One by the Association, and one by AMG, which AMG acknowledged in a letter to the Board of Directors dated January 26th. 

It was important that this letter be made available to the Membership, but when the Board was asked to share this letter with the Unit Owners Mr. Labriola dismissed it out of hand taking an adversarial ‘us vs. them’ stance.  (Frances Mesirow sent it to many unit owners in her letter dated January 30th.  Another copy is attached below.)

Why is Mr. Labriola creating this “They did this to us!”, “They are the bad guys.”, “We must protect our selves!” position?

Why must everyone he disagrees with be treated with such vindictiveness and disrespect?  

Why can’t Mr. Labriola handle this, and other situations, professionally, forthrightly, without malice . . . . . you know, like a respectable adult?

As you will see in the letter below Jonathan Louis, CEO of AMG, is taking an appropriate, professional response to this situation.  It’s reasonable to expect our Association to respond at least as competently and respectfully.  Unfortunately, John Labriola and the Board are choosing to make AMG the enemy.  This is foolish and counter productive.  

Mr. Labriola’s actions are already costing the Association tens of thousands of dollars in legal fees for his litigations.  We deserve better than this childish and costly behavior by an elected Director.

REGARDING: JASON LEVY

Dear Directors:

American Management Group (“AMG”) was made aware that our former employee, CAM Manager of International Village (the “Association”) and AMG’s VP Operations – Jason Levy, is incarcerated. Apparently his incarceration took place recently for an incident that happened in 2007/2008.

This letter is to clear up questions that may be lingering:
  1. 1. Mr. Levy has not been associated with AMG since November 2014.
  2. 2. We hired Mr. Levy in 2012
  3. 3. Mr. Levy had his Real Estate and CAM license which requires fingerprinting and an FBI background check, and renewed it in the licensing year ending 2012, 2014 and most recently 2016.
  4. 4. We are auditing all community files that Mr. Levy had access to in order to ensure that there were no issues and that everything was above board.

We are truly disappointed with this news, and although to‐date we have not found any malfeasance or misfeasance, our first priority is to ensure that the Association financial management entrusted to us is protected; and, that any possible malfeasance or misfeasance is neutralized. Should you be aware of any discrepancies, no matter how small, please notify me immediately as we have placed our carrier on notice regarding this incident. It is also vital that the Associations Crime Policy Carrier (who protects Association Funds) is placed on notice; and, should it be necessary, we will file a claim against AMG’s Fidelity Bond ($2,000,000) and Professional Liability Carrier ($1,000,000) to ensure coverage of the claim(s).

Please also let me know as soon as possible if you would like a face‐to‐face meeting in order to discuss any issues arising from this situation.
